GENERAL DATA PROTECTION REGULATIONS (GDPR)
Inspire Lives Care Services Ltd has a legal duty to explain how we use any personal information we collect about you as a client or user of our services. In order to provide these services we maintain records about your health and the care you receive in electronic and paper format.
What information do we collect about you?
We will collect information such as personal details, including name, address, next of kin, records of care visits, your medical history, medical conditions, treatments and medications etc. and any other relevant information to enable us to deliver effective care.
How we will use your information
Your data is collected for the purpose of providing domiciliary care, otherwise known as homecare: however we can disclose this information if it is required by law, if you give consent or if it is justified in the public interest. Inspire Lives Care Services Ltd may be requested to share your information with other commissioning bodies such as the Adult Social Services Department of Nottingham and Nottinghamshire county and NHS Continuing Care who may also be responsible for commissioning or providing health and social care services to you. In addition we may if requested disclose this information for the purposes of safeguarding to the police or the Local Authority Safeguarding Teams. For us to provide this service we will disclose this information to those of our employees who are responsible for providing care to you. We will not disclose your personal information to any other third party organisation without your express prior permission.
Processing your information in this way and where necessary obtaining your consent ensures we comply with Articles 6(1)(b), and 9(2)(h) of the GDPR.
Article 6(1)(b) Contract: the processing is necessary for a contract you have with the individual, or because they have asked you to take specific steps before entering into a contract.
Article 9(2)(h) for the purposes of preventative or occupational medicine, for the assessment of working capacity of the employee, medical diagnosis, the provision of health or social care or treatment or the management of health or social care.
How we contact/inform clients employees and service users
Inspire Lives Care Services Ltd contacts clients/commissioning bodies/service users/their nominated next of kin/carers and other employees by phone, email and text in accordance with the provisions of the Health and Social Care Act 2012 and The Care Act 2015.
Maintaining confidentiality and accessing your records
We are committed to maintaining confidentiality and protecting the information we hold about you. We adhere to General Data Protection Regulation (GDPR), the NHS Codes of Confidentiality and Security, as well as guidance issued by the Information Commissioner’s Office (ICO). You have a right to access the information we hold about you. If you would like to access this information please contact the Company. Furthermore, should you identify any inaccuracies you have a right to have the inaccurate data corrected.
Invoice Validation
Your information may be shared if you have received care to determine which NHS Clinical Commissioning Group (CCG) or Local Authority is responsible for paying for your care. This information may include your name, address and the dates and times of care services delivered. All of this information is held securely and confidentially; it will not be used for any other purpose or shared with any other third parties.
Opt-outs
You have a right to object to your information being shared. Should you wish to opt out of data collection please contact a member of staff who will explain how you can opt out and prevent the sharing of your information..
Retention Periods
In accordance with the NHS Codes of Practice for Records Management, your client and healthcare records will be retained for 10 years after our contract to provide care services to you ceases, death, or if a service user emigrates, for 10 years after the date of emigration. Inspire lives Care Services Ltd offices or its secure off-site archive facilities.
